Türkiye, Roma Statüsü’ne taraf olsun veya olmasın, Divan’ın yetkisine giren suçlar bakımından doğrudan yargı yetkisine sahip olmasını engellemek için, tamamlayıcılık prensibi çerçevesinde etkili bir iç hukuk mekanizmasına sahip olmalıdır. Türkiye’nin Roma Statüsü’ne taraf olması, teröre karşı yürütülen silahlı mücadelenin tekrar yoğunluk kazanmaması ve gerekli iç hukuk bulunmaktadır. The International Criminal Court and the Effects of the Court on Turkey

Abstract

In order to avoid jurisdiction of the International Criminal Court, Turkey should, whether it becomes a party to the Rome Statute or not, have effective domestic legislation on crimes within the Court’s jurisdiction. Turkey’s accession to Rome Statute greatly depends on level of its struggle against terrorism and the completion of domestic legislation. This article briefly explains crimes within the jurisdiction of the International Criminal Court and their possible effects on Turkey
