Corona (Covid 19) Gölgesinde Geleceğin Hukuku ve Dijital Ekonomi Çağında Rekabet Hukuku

Abstract

Bu çalışmada teknolojik gelişmeler ve dijital hizmetlerle ortaya çıkan yeni ekonomik düzende, dijital hizmetlerin gitgide konvansiyonel iş modellerinin yerini aldığı dijital çağda hukukun dijital piyasalarla genel olarak nasıl bir etkileşim içinde olduğu; bir başka deyişle hukukun dijital ekonomiyi düzenleyip denetlemesinde gündeme gelen sorularla yapay zeka kullanılan dijital hizmetlerin başta avukatlık hizmetleri olmak üzere adalet hizmetlerinde kullanılmasına ilişkin gelişmelere yer verilmiştir. Alman Rekabet Kurumu Bundeskartellamt’ın büyük veri kullanılan dijital piyasalarda rekabet hukukunun uygulanmasına ilişkin çok yönlü tartışmalara konu edilen özetle tüketicinin tercih hakkına öncelik veren Facebook hakkında vermiş olduğu kararı (2019) ekseninde bu karar ile gündeme gelen rekabet hukuku kişisel verilerin korunması ilişkisi ve bu çerçevede dijital piyasalarda rekabet hukukunun uygulanmasında ortaya çıkabilecek yeni meseleler tartışılmıştır. Çalışmanın son bölümünde ise dijital piyasalarda yer alan aktörlerin bu süreç de daha da güçlendiği gerçeğinden hareketle güncelliği nedeniyle Dünya Sağlık Örgütünün Mart 2020’de Corona (Covid-19) küresel salgın ilan etmesini takiben dünyada ve Türkiye’de salgın sürecinde Rekabet Hukuku uygulamalarına ilişkin bazı gelişmelere yer verilmiştir.

In the Shade of Corona (Covid-19) Law of the Future and Competition Law in the Era of Digital Economy

Abstract

In this study, the interplay between law and digital economy in the digital era which indispensibly affects all aspects of our lives has been discussed. Following an overview of the problems arising from the the regulation and the surveillance of digital markets and the developments in the area of using artificial intelligence in judicial activities and in particular in the legal practice; the decision of the Bundescartellamt (Competition Authority in Germany) regarding Facebook is discussed in order to point out the possible competition law issues which arise as a result of the use of big data in digital markets. Finally, at the end of these two headings, due to the common complaints and the need for international cooperation, the enforcement of Competition Law in several jurisdictions including Turkey at the Corona (Covid-19) pandemy process is and the future of competition law is also touched upon.
