The right to hold meetings and demonstration marches is a fundamental right in a democratic society. Usually three different systems are provided in the use of freedoms: freedom, authorization and notification procedure. The system of authorization is forbidden under the Turkish Constitution regarding to hold meetings and demonstrations. In the related Law, the notification procedure is regulated. When the notification procedure is used out of its purpose, it may turn into the authorization system in practice. Therefore, the notification procedure which is guaranteed under the constitution should be regulated and implemented in a way that may not lead this right to dysfunctional. In this study, the notification procedure will be explained and examined by considering the decisions of both the Constitutional Court and the European Court of Human Rights.

Toplantı ve gösteri yürüyüşü hakkı demokratik toplumlarda temel bir unsurdur. Özgürlüklerin kullanılmasında genel olarak serbestlik, izin ve bildirim olmak üzere üç farklı sistem öngörülmektedir. Türkiye’de anayasal düzenleme, toplantı ve gösteri yürüyüşü hakkının önceden izin alamadan yapılacağını belirtmektedir. İlgili Kanun’da ise bildirim usûlü öngörülmüştür. Bildirim usûlünün kullanımı, amacına uygun gerçekleştirilmediği zaman fiilen izin sistemine dönüşme riskini taşımaktadır. Dolayısıyla bildirim usûlü Anayasa’da güvence altına alınan izin almadan kullanılacak bu hakkı işlevsiz hale getirmeyecek şekilde düzenlenmeli ve uygulanmalıdır. Bu çalışmada, bildirim usûlü gerek Anayasa Mahkemesi gerekse İnsan Hakları Avrupa Mahkemesi kararları da dikkate alınarak açıklanacak ve incelenecektir.
