AİHM’İN ÇEVRE İÇTİHATLARININ İKLİM DEĞİŞİKLİĞİ DAVALARINA UYGULANABİLİRLİĞİ

Öz

Çevre hakkını ayrıca ve açıkça düzenlemeyen Avrupa İnsan Hakları Sözleşmesinin (Sözleşme veya AİHS) denetim mekanizması olan Avrupa İnsan Hakları Mahkemesinin (AİHM) önüne çevre ile ilgili uyuşmazlıklar sıklıkla gelmektedir. Mahkemenin bugüne kadar çevresel meselelerle ilgili vermiş olduğu kararlar özellikle yaşam hakkı, özel ve aile hayatına saygı hakkı ile ilişkilendirilmektedir. Ayrıca Mahkemenin yargı yetkisine dair içtihatları bulunmaktaysa da sınır aşan çevresel zararlara dair yargı yetkisine ilişkin henüz verilmiş bir karar bulunmamaktadır. Yanı sıra son zamanlarda Mahkemeye iklim değişikliğinin zararlı etkileri sebebiyle Sözleşmedeki haklarının ihlal edildiğinden bahisle davalar da açılmaktadır. AİHM önüne gelen iklim değişikliği davaları yeni bir olgu olmasına karşılık henüz bu konuda Mahkeme tarafından verilmiş bir karar bulunmamaktadır.
İklim değişikliği davaları, iklim değişikliğinin zamana yayılan kümülatif etkileri sebebiyle, zarar riskinin ve mağduriyetin kanıtlanması; sınır aşan çevresel zararların meydana gelmesiyle devletlerin yargı yetkisinin belirlenmesi açısından zorluklar taşımaktadır. Bu makale mahkemenin daha önceden verdiği çevre içtihatlarının derdest olan iklim değişikliği davalarında uygulanabilirliğini özellikle sınır aşan çevresel zararlar karşısında mahkemenin yargı yetkisini nasıl belirleyeceği, başvurucuların mağdur statüsünü nasıl değerlendireceği ve yaşam hakkı ile özel ve aile hayatının korunması hakkının ihlal edilip edilmediğini inceleme yöntemi açısından ele almaktadır.
