7552 SAYILI İKLİM KANUNU BAĞLAMINDA EMİSYON TİCARET SİSTEMİNİN ANAYASAL TEMELİ VE TASARIM SINIRLARI
Abstract
Emisyon ticaret sistemi, devletlerin iklim değişikliğiyle mücadelede başvurduğu emir, yasak ve teknik standartlara dayalı geleneksel çevre koruma araçlarına alternatif olarak geliştirilmiş bir düzenleme modelidir. Sistem, emisyonlara bir üst sınır getirirken kirleticilere azaltımın yöntemini ve zamanını seçme imkânı tanımaktadır. Böylece çevresel hedeflere daha düşük maliyetle ulaşılması amaçlanmaktadır.
Ne var ki bu esneklik, devletin çevrenin korunmasında geri plana çekildiği anlamına gelmemektedir. Aksine sistem, birçok aşamada yoğun kamusal müdahale gerektirmektedir. Emisyon ticaret sisteminde devlet, izin verilen toplam sera gazı emisyonunu belirlemekte ve bu miktarı tahsisat adı verilen ölçülebilir ve standart birimlere ayırmaktadır. Ayrıca tahsisatların dağıtımını gerçekleştirmekte, piyasanın işleyiş kurallarını belirlemekte ve çevresel denetim ile piyasa denetimini yürütmektedir. Bu yönüyle emisyon ticareti, serbestçe oluşan bir piyasadan ziyade, devlet müdahalesinin piyasa biçimi içinde yeniden düzenlendiği bir çevre koruma rejimi niteliği taşımaktadır.
Çalışmanın konusunu, 7552 sayılı İklim Kanunu bağlamında hukuki çerçevesi oluşturulan emisyon ticaret sisteminin anayasal temeli ve bu temelden doğan tasarım sınırları oluşturmaktadır. İncelemede öncelikle sistemin iktisadi temelleri ve kirleten öder ilkesiyle ilişkisi ele alınmaktadır. Daha sonra Anayasa’nın sağlıklı ve dengeli bir çevrede yaşama hakkını düzenleyen 56’ncı maddesi ile doğal servet ve kaynaklara ilişkin 168’nci maddesi üzerinde yoğunlaşmaktadır.
Emisyon üst sınırı, tahsis mekanizması ve izleme-raporlama-doğrulama rejimi kanunilik ilkesi yönünden; üçüncü taraf doğrulayıcılarının konumu ise Anayasa’nın 128’inci maddesi çerçevesinde ele alınmaktadır. Ayrıca, tahsisatlarının hukuki niteliğine ilişkin tartışma da incelemenin bir diğer yönünü oluşturmaktadır.

THE CONSTITUTIONAL BASIS AND DESIGN CONSTRAINTS OF THE EMISSIONS TRADING SYSTEM UNDER CLIMATE LAW NO. 7552
Abstract
The emissions trading system is a regulatory model developed as an alternative to traditional environmental protection instruments based on commands, prohibitions, and technical standards. While imposing an overall cap on emissions, the system allows polluters to choose the method and timing of their emission reductions. It thereby seeks to achieve environmental objectives at a lower cost.
This flexibility, however, does not mean that the state withdraws from environmental protection. On the contrary, the system requires intensive public intervention at several stages. Under an emissions trading system, the state determines the total amount of permissible greenhouse gas emissions and divides this amount into measurable and standardised units known as emission allowances. It also allocates the allowances, establishes the rules governing the operation of the market, and conducts both environmental and market supervision. In this respect, emissions trading constitutes not a freely formed market but an environmental protection regime in which state intervention is reorganised through a market-based structure.
This study examines the constitutional basis and resulting design limits of the emissions trading system established under Climate Law No. 7552. It first addresses the economic foundations of the system and its relationship with the polluter pays principle. It then focuses on Article 56 of the Constitution, which guarantees the right to live in a healthy and balanced environment, and Article 168, which governs natural wealth and resources.
The emissions cap, allowance allocation mechanism, and monitoring, reporting, and verification regime are examined in light of the principle of legality, while the status of third-party verifiers is assessed under Article 128 of the Constitution. The legal nature of emission allowances constitutes another aspect of the analysis.
