ÖZEL GÜVENLİK MEVZUATININ PERSONELİNE TANIDIĞI YETKİLER KAPSAMINDA İNCELENMESİ: TÜRKİYE CUMHURİYETİ ve FRANSA ÖRNEĞİ

Abstract

Özel güvenlik sektörü, Türkiye Cumhuriyeti ve yurt dışında güvenlik ve emniyetin çok önemli bir bileşeni ve tamamlayıcısıdır. Bugün özel güvenlik, yalnızca ülkelerdeki birçok kurumun ve kritik altyapı sistemlerinin korunmasından değil, aynı zamanda fikri mülkiyetin ve hassas kurumsal bilgilerin korunmasından da sorumludur. Devletler ayrıca kıymetli maden taşımacılığı ve bankaların fiziki güvenliğini sağlama ve diğer birçok işlev dahil olmak üzere çok çeşitli görevler için özel güvenliğe büyük ölçüde güvenmektedir. Uluslararası sistemde örnekleri olmakla beraber şirketler ayrıca özel güvenliğe büyük yatırım yapmakta ve özel soruşturmalar, istihdam öncesi tarama ve bilgi teknolojisi (BT) güvenliği gibi işlevleri yerine getirmesi için güvenlik firmalarından faydalanmaktadırlar. Dolayısıyla hayatımızın birçok alanına nüfuz etmiş özel güvenlik teşkilatlarının hukuki altyapıları da bu minvalde önem arz etmektedir.
Ülkelerin bulundukları coğrafi konum, kültürel yapıları ve yönetim şekilleri gibi birçok hususun etkisiyle biçimlenmiş özel güvenlik kanunları, diğer devlet kanun yapıcıları tarafından da ayrıca incelenmekte ve gerekli görülmesi halinde benzer yada aynı şekilde ilgili kanun/maddeler alınmaktadır. Bu çalışmada Türkiye Cumhuriyeti’nde kullanılan Özel Güvenlik Mevzuatı ve Fransa’da kullanılan Özel Güvenlik Mevzuatı incelenmiştir. Özel kolluk yetkileri üzerinde durulmuş, genel hatlarla açıklanmaya çalışılmıştır.

The Problem of Physician Intervention in Hunger Strike of Prisoners in the Light of the ECHR Decisions

Abstract

The private security sector is a critical component and supplement of security and safety in the Republic of Turkey and abroad. Today, private security is responsible for protecting not only many institutions and critical infrastructure systems in countries, but also intellectual property and sensitive corporate information. States also rely significantly on private security for precious metals transportation, bank security, and a variety of other responsibilities. While there are examples in the international system, companies also invest heavily in private security and use it to perform tasks such as private investigations, pre-employment screening, and information technology (IT) security. Therefore, the legal infrastructure of private security organizations that have penetrated many aspects of our lives is also crucial.
Private security laws, shaped by many factors such as countries’ geographical location, cultural structures, and management styles, are also examined by lawmakers, and similar laws/articles are enacted if deemed necessary. In this study, the Private Security Legislation used in the Republic of Turkey and the Private Security Legislation used in France were examined. Special law enforcement authorities have been highlighted and attempted to be explained in general terms.
