Abstract
Osmanlı Devleti’nde hapis cezası yaygın bir ceza olarak XIX. yüzyıldan itibaren uygulanmaya
başlamıştır. Örfi hukuk içerisinde yer alan hapis cezası, kanunname ve adaletnamelerle
düzenlenmiştir. Osmanlı Devleti’nde hapis cezasının infaz edildiği yerler kale ve hisarların içlerinde
bulunan zindanlar olmuştur. Hapis cezasının etkin bir şekilde ele alınıp hürriyeti bağlayıcı bir
cezalandırma yöntemi olarak tanımlanması ise Tanzimat döneminde kabul edilen 1840, 1851 ve
1858 ceza kanunları sayesinde olmuş ve 1880 tarihli Tevkifhane ve Hapishaneler Nizamnamesi ile de
hapishane olgusu bugünkü anlamıyla adalet sistemi içinde yerini almaya başlamıştır.
XVIII. yüzyılda artmaya başlayan ve XIX. yüzyıldan itibaren artan siyasi, adli, iktisadi buhranlar ve
kargaşa durumu hapishanelere gereksinimi arttırmıştır. Bu amaçla devlet ülkenin pek çok yerinde
hapishaneler inşa etmeye çalışmış ya da uygun binaları kiralayarak hapishaneye dönüştürmüştür.
Bunlardan biri olan Dinar hapishanesinin XX. yüzyıl başlarında durumu arşiv belgeleri ışığında
değerlendirilecektir.
Abstract
Imprisonment as a punishment common in the Ottoman Empire XIX. From the eleventh century
began to be implemented. Imprisonment contained in customary law, and justice, it is regulated by
kanunname. In the Ottoman Empire, where a sentence of imprisonment the execution of the interior
of the castle and fortress has been found in the dungeons. Of imprisonment effectively addressed
and restricting freedom of punishment as a method of identifying the Tanzimat period adopted in
1840, 1851 and 1858 criminal laws been through and 1880 Tevkifhane and Prisons Regulations and
the prison phenomenon with its current meaning within the justice system to take its place began.
XVIII. and XIX century began to increase. century, from the growing political, judicial, economic
upheavals and turmoil has increased the need for state prisons. For this purpose, the state in many
parts of the country have worked to build prisons or prison was transformed by renting suitable
premises. One of these Dinar XX of prison. century, the situation will be assessed in the light of
archival documents.
