Avrupa Birliği Yolunda Türkiye İnsan Hakları Kurumu’nun Birleşmiş Milletler Paris Prensipleri Işığında Değerlendirilmesi

Abstract

Avrupa Birliği, üyelik yolunda ilerleyen Türkiye’den insan haklarının korunması ve geliştirilmesi kapsamında Birleşmiş Milletler Paris Prensipleri ile tam uyumlu bir ulusal insan hakları kurumu kurmasını şart koşmuştur. Bu çalışmada, Türkiye’nin söz konusu çerçevede kurduğu Türkiye İnsan Hakları Kurumu’nun Paris Prensipleri ile tam uyumlu olup olmadığı sorgulanacaktır. Sorgulama, Paris Prensipleri’nin ulusal insan hakları kurumları için sağladığı bağımsızlık ve yetki güvenceleri çerçevesinde yapılacaktır. Çalışmada, ayrıca, Paris Prensipleri ile uyumlu ve uyumsuz düzenlemeler tespit edilecek ve uyumsuz düzenlemelere yönelik çözüm önerileri getirilecektir. Bu çalışmanın, mevcut kuruma olduğu kadar olması gerekene de ışık tutması planlanmaktadır

An Evaluation Of The Turkish Human Rights Institution In The Light Of United Nations Paris Principles On The Way To The European Union

Abstract

EU stipulated that Turkey, moving ahead on the way to membership, establish a national human rights institution in full conformity with UN Paris Principles within the scope of the protection and promotion of human rights. In this study, it will be questioned whether the Turkish Human Rights Institution, which Turkey established within the context in question, is in full conformity with the Paris Principles. This questioning will be done within the framework of the independence and mandate assurances that the Paris Principles provide for national human rights institutions. Also, in this study, the provisions that are consistent and inconsistent with the Paris Principles will be detected and solutions for inconsistent provisions will be offered. It is planned that this study will shed light on the required institution as well as the existing one.
