Kişilik hakkı internet ortamında yapılan yayınlar nedeniyle sık
sık ihlal edilmektedir. 5651 sayılı İnternet Ortamında Yapılan Yayınların
Düzenlenmesi ve Bu Yayınlar Yoluyla İşlenen Suçlarla Mücadele
Edilmesi Hakkında Kanun’un 9. maddesi ile internet ortamında
kişilik hakkının ihlal edildiğini iddia edenler, uyar kaldır yöntemine
veya yargı yoluna başvurabilmektedir. Bu çalışmada 9. madde ile
getirilen korunma usulleri incelenecektir. Ayrıca söz konusu maddenin
29.07.2020 tarihinde kabul edilen 7253 sayılı Kanun ile uğradığı
değişikliklere değinilecektir. Bu doğrultuda sosyal ağ sağlayıcıya
başvuru imkânı getirilmesi sebebiyle sosyal ağ sağlayıcının kapsamı
tartışılacak ve mezkûr maddeye eklenen 10. fıkranın unutulma
hakkı ile ilişkisi ele alınacaktır. Son olarak kişilik hakkının ihlali
yargı kararları eklenmek suretiyle örneklendirilecektir.
Personal rights are frequently violated because of the publications
on the Internet. The ones claming the violation of personal right on this
environment via the 9th article of law 5651 on regulation of publications
on the internet and suppression of crimes committed by means of such
publications may apply to the method of notice and take down or
judicial remedy. In this item, the protection procedures brought via the
9th article will be examined. Besides, the changes coming via the law
7253 accepted on 29.07.2020 on the aferosaid item will be mentioned.
Accordingly, the content of the social network provider will be discussed
because of bringing application opportunity to social network provider.
Also, its relation with the oblivion right of the 10th article added to the
aferosaid item will be discussed. Lastly, the violation of the personal
right is exemplified by adding the judicial decisions.
