Türk Bayraklı Gemilerin Denizcilik Çalışma Sözleşmesi (MLC) Kapsamında Eksikliklerinin Belirlenmesi: Paris Mou Denetim Raporlarının İncelenmesi

Abstract

Denizcilik sektöründe yakın gelecekte yaşanacak olan gemiadamı arz-talep dengesindeki sıkıntı gemilerde çalışacak gemiadamına olan ihtiyacı her geçen gün arttırmaktadır. Bu durumun önüne geçmek için denizcilik mesleğinin insana yakışan şartlarda icra edilmesi gerekmektedir. Uluslararası Denizcilik Örgütü (IMO) ve Uluslararası Çalışma Örgütü (ILO) denizcilikteki insan kaynaklarının şartlarını iyileştirmek için MLC konvansiyonunu çıkarmıştır. Bu konvansiyon ile denizcilikle ilgili insan kaynakları yönetimi alanında yeni kurallar getirilmiş ve insana yakışır bir çalışma ortamı hedeflenmiştir. Bu çalışma ile Türk Bayraklı gemilerin MLC konvansiyonu kapsamında eksikliklerinin neler olduğu tespit edilerek çözüm önerileri sunulması amaçlanmıştır. MLC konvansiyonunu kabul sürecinde oluşturulacak strateji ve politikaların belirlenmesi ülkemizin ekonomik ve ticari politikaları açısından önemlidir. Bu kapsamda Türk Bayraklı gemilerin Paris MoU kapsamında eksiklik tespit edilen denetim raporları (n=376) doküman analizi yöntemi ile incelenmiştir. Analizler ile elde edilen sonuca göre devlet politikaları belirlenerek MLC standartlarına uyumun sağlanması konusunda işletmeler teşvik edilmelidir. Bilinçli ve sürdürülebilir politikalar ile işletmelerin yönetim anlayışı değiştirilmeli ve gemiadamlarının yaşam ve çalışma koşulları iyileştirilmelidir. Gemiadamlarının haklarını savunabilecekleri sendikalaşma haklarının oluşturulması ve şikâyet mekanizmalarının kurulması gerekmektedir. Türkiye Cumhuriyeti’nin ülke menfaatlerine uygun olan konvansiyonlara taraf olup gerekli yatırımları yaparak modern ve örnek gösterilen bir filoya sahip olması sağlanmalıdır.

Identification of Deficiencies of Turkish Flagged Ships in the Scope of Maritime Labour Convention (MLC): Examining the Paris MOU Inspection Reports

Abstract

The problem in the seafarer supply-demand balance, which will be experienced in the maritime sector soon, increases the need for seafarers to work on ships day by day. To prevent this situation, maritime profession should be carried out in humane conditions. International Maritime Organization (IMO) and International Labour Organization (ILO) have issued MLC convention to improve the conditions of human resources in the maritime. With this convention, new rules have been brought in the field of human resources management related to maritime and a decent working environment has been targeted. This study, it is aimed to determine deficiencies of Turkish Flagged ships within the scope of MLC convention and to offer solutions. Determining the strategies and policies to be formed in the process of ratifying MLC convention is important in terms of our country's economic and commercial policies. In this context, inspection reports (n=376) of Turkish-flagged ships, which were found to be deficient within the scope of Paris MoU, were examined by document analysis method. According to results obtained from analyses, state policies should be determined and businesses should be encouraged to ensure compliance with MLC standards. With conscious and sustainable policies, management approach of enterprises should be changed and living and working conditions of seafarers should be improved. It is necessary to establish unionization rights and to establish complaint mechanisms, where seafarers can defend their rights. It should be ensured that the Türkiye has a modern and exemplary fleet by being a party to the conventions that are in line with the interests of the country and making the necessary investments.
