Çalışanların Temel Haklarının Korunması ve Serbest Ticaret Anlaşmaları - AB Kore Serbest Ticaret Anlaşmasına İlişkin Panel Kararı Işığında

Abstract

2000’li yıllar sonrasında serbest ticaret anlaşmalarında yer alan çalışanların haklarına ilişkin düzenlemelerin sayısında hızlı bir artış gözlenmiştir. Türkiye’nin imzaladığı serbest ticaret anlaşmalarında da örneklerine rastladığımız bu düzenlemeler, çalışanların haklarının korunması ve geliştirilmesi için yeni bir hukuki araç olarak değerlendirilebilir. Avrupa Birliği ile Kore Cumhuriyeti arasındaki Serbest Ticaret Anlaşması’nda yer alan bu tip bir düzenlemeye ilişkin verilen 20 Ocak 2021 tarihli Panel kararı, serbest ticaret anlaşmalarında yer alan çalışanların haklarına ilişkin düzenlemelerin hukuki etkisine ilişkin tartışmaları farklı bir boyuta taşımıştır. Bu çalışmayla amaçlanan, Panel Kararını tanıtmaktan ve çalışanların sendikal özgürlüklerinin korunmasında farklı bir hukuki aracın gelişmekte olduğunu göstermekten ibarettir.
