Between Reputation and Asylum: Anti-Immigrant Discourse, Hate Speech Law, and toward a Four-Step Assessment Model

Abstract

This article develops an actionable framework for courts and regulators to assess anti-immigrant expression without chilling core political debate. Combining Strasbourg proportionality under Article 10 ECHR with Luxembourg information-law balancing and national case studies, we construct a structured hand-coded case matrix of leading and illustrative judgments from the ECtHR, the CJEU, and selected national courts. Decisions are coded by discourse type, speaker status, medium, target-group vulnerability, intent/foreseeability, context, and harm evidence. Building on this, we propose a four-step review: (i) discourse classification; (ii) context metrics (electoral timing, reach, counter-speech, local tensions); (iii) a harm-threshold score (0–12) derived from intensity, vulnerability, context, and harm; and (iv) a sanction matrix ranking remedies by intrusiveness and effectiveness (declaration, targeted content measures, calibrated damages, administrative orders, and—only in high-risk cases—criminal sanctions or equivalent-content injunctions). Comparative analysis shows convergence around a broader remedial threshold: courts intervene where dehumanizing rhetoric targets migrants in aggravating contexts and foreseeable harm is evidenced, while preserving breathing space for policy critique and journalism. The model minimizes Type-I error (over-enforcement) and Type-II error (under-enforcement), aligns with intermediary duties in digital spaces, and yields transparent, reviewable reasons. We conclude with practice checklists for judges, platforms, and newsrooms, and a research agenda linking doctrinal coding to platform transparency data.

İtibar ve İltica Arasında: Göçmen Karşıtı Söylem, Nefret Söylemi Yasası ve Dört Aşamalı Değerlendirme Modeli

Abstract

Bu makale, çekirdek siyasal tartışmayı soğutmadan göçmen karşıtı ifadeyi değerlendirmek için mahkemeler ve düzenleyicilerce uygulanabilir bir çerçeve önerir. Strasbourg orantılılık (AİHS m.10), Lüksemburg bilgi hukuku dengesi ve ulusal içtihatlar birleştirilerek AİHM, ABAD ve seçilmiş yüksek mahkeme kararlarından oluşan el kodlamalı bir veri seti oluşturulmuştur. Kararlar; söylem türü, konuşmacı statüsü, mecra, hedef grubun kırılganlığı, kast/öngörülebilirlik, bağlam ve zarar göstergelerine göre kodlanmıştır. Buradan hareketle dört aşamalı bir inceleme sunulur: (i) söylem sınıflaması; (ii) bağlam metrikleri (seçim dönemi, erişim, karşı-söz, yerel gerilimler); (iii) yoğunluk–kırılganlık–bağlam–zarar bileşenlerinden türeyen 0–12 zarar eşiği skoru; (iv) yaptırım matrisi (bildirim, hedefli içerik önlemleri, ölçülü tazminat, idari tedbirler ve yalnız yüksek riskte ceza/“eşdeğer içerik” tedbirleri). Karşılaştırmalı analiz, “tazminat eşiği” üzerinde yakınsama gösterir: dehumanize eden retoriğin, ağırlaştırıcı bağlamda göçmenleri hedef aldığı ve öngörülebilir zarar kanıtlandığı durumlarda müdahale; buna karşılık politika eleştirisi ve gazetecilik için “nefes alma alanı” korunur. Model, aşırı-müdahale ve eksik-müdahale hatalarını azaltır, dijital aracı sorumluluğu ile uyumludur ve şeffaf, denetlenebilir gerekçeler üretir. Hakimler, platformlar ve haber odaları için kontrol listeleri ve şeffaflık verileriyle bağlantılı araştırma gündemi önerilir.
