Abstract

Makalemizde temelleri vahiy dönemine kadar uzanan ve cezaların ıskatında müessir
olan şüphe unsuru ele alınacaktır. Sanığın korunmasın"ı amaçlayan ilkenin unsurları ve
masumluk karinesiyle bağlantısı üzerinde durulacak, konu hakkında farklı mezhep görüşlerine
yer verilecek ve ilkenin modern hukuktaki yri üzerinde ayrıca durulacaktır.

Abstract

In this article we have given the title of "The Accused's benefitting from suspicion
affecting on dropping punishments, the bases of which date back to the period of revelation is
going to exarnined. W e are going to focus on the elements of the principle aiming the protection
of the accused and on its relation with the evidence of innocence, and so opinions of different
sects are going to be dea!! with, and the place of the principle in the modern law is particularly
concentrated on.
