Legislation, Execution, Judgment: An Overview of The State Functions From Platon to Montesquieu

Abstract

Legal entity state has various organs. Differences between state organs, reveal the diversity of the state functions also. The principle of separation of powers, that containing the separation of legislative, executive and judicial functions of state, developed in the West depending on the political philosophy of 17. and 18. century, and it aims to protect fundamental rights and freedoms in general. In this study, it is examined that how the emergences of the state functions with a philosophical perspective.
