The Mental Reasons of the Method of Istihsan and Some Application Forms

Abstract

This article concerns istihsan (juristic preference), one of methods in islamic law methodology. The study, first, defines istihsan as a concept, and secondly its mental reasons, i.e. darurah (necessity), maslaha (public interest), „urf (custom), dharai (means), and lastly its application forms, resulting from these mental reasons, i.e. istisna (exeption), tercih (prefer) dispensation (rukhsa).

İstihsan Yönteminin Aklî Gerekçeleri ve Bazı Uygulama Şekilleri

Öz

Bu makale, islam hukuk metodolojisi metotlarından biri olan istihsanı ele almaktadır. Çalışma öncelikle kavram olarak istisanı, sonra bu yönteme başvurmaya götüren zaruret, maslahat, örf, zerayi gibi akli gerekçeleri, son olarak da uygulama sürecinde bu gerekçelerin doğurduğu istisna, ruhsat, tercih gibi uygulama şekillerini ele almaktadır.
