6102 sayılı Türk Ticaret Kanunu’nun 5. Kitabında yer alan 1178 ila 1192. maddeleri, taşıyanın yüke özen sorumluluğunu düzenleyen hükümlere yer vermektedir. İşbu hükümler uyarınca; taşıyanın yüke özen sorumluluğunun kapsamı, sorumluluktan kurtulma nedenleri, inceleme ve bildirim, sorumluluk sınırları, hak düşürücü süre, sözleşme dışı istemler ile fiili taşıyanın sorumluluğu düzenlenmiştir. Kendisine karşı yüke özen sorumluluğu tesisi süreci başlatılan taşıyanın; sorumluluktan kurtulma hallerinin uygulanabilirliğini denetlemesi öncesinde, sorumluluk tesisinde ispat yükünün yerini değiştirmek için, müşterek incelemenin varlığını veya yükle ilgiliye atfedilen bildirim yükümlülüğünün yerine getirilip getirilmediğini denetlemek imkanları bulunmaktadır. Bunların her ikisinin yokluğunda, taşıyan lehine ikili bir sorumsuzluk karinesi doğacak ve taşıyanın yüke özen sorumluluğunun tesisi talebinde bulunan kişi bu karineleri çürütmedikçe; eşyanın taşıma senedinde yazılı olduğu gibi taşıyanca teslim edildiği ve zararın taşıyanın sorumlu olmadığı bir sebepten ileri geldiği kabul olunacaktır. Bu nedenle; yüke özen sorumluluğunun tesisinde oldukça büyük önemi haiz “müşterek inceleme”, çalışmada; tatbik kabiliyeti, hükümleri ve uygulamada ortaya çıkan birtakım sorunlar kapsamında değerlendirilmiş, sorunların çözümüne ve bu şekilde hükmün tadiline yönelik değerlendirmelerde bulunmak amaçlanmıştır.
Articles 1178 to 1192 in Book 5 of the Turkish Commercial Code No. 6102 include the provisions regulating the carrier's duty of care for the cargo. Under these provisions, the scope of the carrier's duty of care for the cargo, grounds for release from liability, inspection and notification, limits of liability, limitation period, extra-contractual claims, and the liability of the actual carrier are regulated. The carrier, against whom the process of establishing the duty of care for the cargo has been initiated, has the opportunity to check the existence of a joint inspection to shift the burden of proof to establish liability or to check whether the obligation of notification attributed to the person concerned with the cargo has been fulfilled before checking the applicability of the cases of release from liability. In the absence of both of these, a double presumption of irresponsibility will arise in favor of the carrier, and unless the person claiming the establishment of the carrier's responsibility for the care of the cargo rebuts these presumptions, it will be accepted that the goods were delivered by the carrier as written in the bill of lading and the damage was caused by a cause for which the carrier is not responsible. For this reason, the "joint inspection," which is of great importance in the establishment of the duty of care for the cargo, has been evaluated within the scope of its applicability, its provisions, and some problems arising in practice, and it is aimed to make evaluations for the solution of the problems and the amendment of the provision in this way.
