THREE MOMENTS ON THE FUNCTION OF THE LAW IN THE TRIAL OF SOCRATES: EUTHYPHRO, APOLOGIA, AND CRITO

Abstract

This study examines Plato's Euthyphro, Apologia, and the Crito for the function of law in the process of Socrates' death. It can be said that there are different conceptions of Socrates' death. For example, while some see this death as a death consistent with his life, others read Socrates' attitude toward the law as a means of maintaining the established order. Socrates' thoughts on death led him to surrender to what he was destined to do, and in this manner Socrates' death was seen as suicide. Socrates' claim is that he had a mission to serve the social unity in which he lived, and that a better life was possible by fulfilling this mission. The aim of this study is to question the possibility of a virtuous life as formulated by Socrates and to determine whether Socrates himself acted in accordance with his current mission when he went to his death. In this context, the correctness of his unconditional submission to the law is discussed.

SOKRATES’İN DAVASINDA YASANIN İŞLEVİ ÜZERİNE ÜÇ UĞRAK: EUTHYPHRON, SOKRATESİN SAVUNMASI VE KRİTON

Abstract

Bu çalışma Sokrates’in ölüm sürecinde yasanın işlevini Platon’un Euthypron, Sokrates’in Savunması ve Kriton adlı eserlerinde resmedildiği biçimiyle ele almaktadır. Sokrates’in ölümüne ilişkin farklı kavrayışların olduğunu söylemek mümkündür. Buna göre kimileri bu ölümü yaşamıyla tutarlı bir ölüm olarak değerlendirirken, kimileri yasa karşısında Sokrates’in tutumunu kurulu düzenin sürdürülmesinin bir aracı olarak okurlar. Sokrates’in ölüme ilişkin düşünceleri onu yazgılı olduğu şeye teslim olma biçiminde yönlendirmiş bu biçimiyle de Sokrates’in ölümü intihar olarak değerlendirilmiştir. Sokrates’in iddiası içinde yaşamış olduğu toplumsal birlikteliğe hizmet etmek yönünde bir misyonunun bulunduğu ve bu misyonu yerine getirmek suretiyle daha iyi bir yaşamın mümkün olduğu yönündedir. Bu çalışmanın amacı Sokrates’in formüle ettiği biçimiyle erdemli yaşamanın imkânını sorgulama ve Sokrates’in bizatihi kendisinin ölüme giderken hâlihazırdaki misyonuna uygun davranıp davranmadığını tespit etmektir. Bu bağlamda onun yasalara koşulsuz olarak boyun eğmesinin doğruluğu tartışılmıştır.
