1151/2012 Sayılı Avrupa Parlamentosu ve Konseyi Tarım Ürünleri ve Gıda Maddeleri ile İlgili Kalite Düzenlemeleri Tüzüğünde Şartname Kavramı

Öz

03 Ocak 2013 tarihinde 1151/2012 sayılı Avrupa Parlamentosu ve Konseyi Tarım Ürünleri ve Gıda Maddeleri ile İlgili Kalite Düzenlemeleri Tüzüğü yürürlüğe girmiştir1. 1151/2012 sayılı Tüzüğün amaçları tarımsal ve kırsal kalkınmayı gerçekleştirmek, sınai mülkiyet haklarını korumak, iç pazarın bütünlüğünü korumak ve tüketicilere ürünlerin kaynaklandıkları coğrafi bölgeler ile ilgili doğru bilgi vermektir. Tüzük sadece coğrafi işaretleri ve menşe adları ile ilgili hükümleri içermemekte ayrıca geleneksel özellikli ürünleri ve ihtiyari kalite terimleri ile ilgili hükümleri de içermektedir. Avrupa Birliği’nde coğrafi işaret ve menşe adı tescilli tarım ürünleri ve gıda maddelerinin 2010 yılında toplam satışı 15.8 milyar Avro’dur2. Ticaret hacminin bu kadar çok olduğu coğrafi işaret ve menşe adı tescilli ürünlerin ulusal ve uluslararası alanda korunmaları her geçen gün önem kazanmaktadır. Makalede coğrafi işaret ve menşe adı başvurusunun en önemli belgesi olan şartname kavramı ile ilgili açıklamalar ve şartname hazırlanırken dikkat edilecek hususlar incelenmektedir. Makalede ayrıca 1151/2012 sayılı Avrupa Parlamentosu ve Konseyi Tarım Ürünleri ve Gıda Maddeleri ile İlgili Kalite Düzenlemeleri Tüzüğü’nün kapsamı, tüzükte tanımlanan menşe adı ve coğrafi işaret kavramları, tüzükte belirtilen şartname kavramı ve konuyla ilgili önemli Avrupa Birliği Adalet Divanı Kararlarına yer verilmektedir

SPECIFICATION TERM ON THE REGULATION (EU) NO 1151/2012 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF 21 NOVEMBER 2012 ON QUALITY SCHEMES FOR AGRICULTURAL PRODUCTS AND FOODSTUFFS

Öz

Regulation No 1151/2012 of the European Parliament and of the Council on Quality Schemes for Agricultural Products and Foodstuffs entered into force on 03 January 2013. The aims of the Regulation (EU) No 1151/2012 are to realize agricultural and rural development, to protect intellectual property, to protect internal market’s integrity and to provide right information on products linked to geographical origin. The Regulation does not only contain articles about geographical indications and designation of origins but also about traditional specialities guranteed and optional quality terms. In the European Union the total sales value of agricultural products and foodstuffs registered as geographical indication and designation of origin were €15.8 billion in 2010. The protection of the registered products in national and international area is becoming more important every passing day where the trade volume of registered geographical indication and designation of origin products is this much. The explanations of specification term, which is the most important document of geographical indication and designation of origin application and the points considered when preparing the specification, are examined in the article. The scope of the Regulation No 1151/2012 of the European Parliament and of the Council on Quality Schemes for Agricultural Products and Foodstuffs, the terms of designation of origin and geographical indication defined in the regulation, the specification term specified in the regulation and the relevant important European Court of Justice Decisions related with the subject are also included in the article
