Genel Olarak Milletlerarası Spor Tahkim Mahkemesi (CAS) ve Bu Mahkemede Uygulanan Tahkim Çeşitleri

Abstract

Spor, günümüz dünyasında gerek izleyici gerekse profesyonel olarak pek çok insanın ilgilendiği bir faaliyet olup kitleler arasında giderek daha da fazla yaygınlık kazanmaktadır. Bu süreç içerisinde milletlerarası spor müsabakaları özel bir yer tutmaktadır. Bu tip müsabakalara çok başarılı, tabir caiz ise mesleğinin zirvesindeki sporcular katıldığından müsabakalar üst düzeyde çekişmelere sahne olmakta; bunun doğal bir sonucu olarak zaman zaman uyuşmazlıklar da meydana gelmektedir. İşte bu uyuşmazlıkların kısa sürede, uzman kişilerce hallolunmasına büyük bir ihtiyaç duyulmaktadır. Zira sporcuların bir sonraki müsabakaya katılıp katılamayacakları genellikle meydana gelen uyuşmazlığın bir an önce ve bağlayıcı biçimde çözülmesine bağlıdır. Duyulan bu ihtiyacı karşılamak üzere, hakkında aşağıda daha geniş bilgi verilecek olan Milletlerarası Spor Tahkim Mahkemesi kurulmuştur. Bahsi geçen Mahkeme Türk spor hukuku bakımından da önemli bir yere sahiptir. Zira Türk sporcularıyla ilgili spor hukukundan doğan uyuşmazlıkların da bu mahkeme önüne götürülmesi mümkündür.
