THE CANONICALLY LAWFUL (ISTIHALAH) IN THE FIQH TEXTS FROM THE VERIFIABLE PRINCIPLES OF THE POINT OF VIEW AND CURRENT FINDINGS
Abstract
The term of transformation
is generally used for impure
matters in order to be altered
to a different matter whether
in its natural environment or
by the way of interference.
In this article to give general
information, the common
examples and evaluation
methods all of the fiqh sects
are tried to put forward.
Although the jurisprudents’
definitions for the transfor
mation are close to
each other, they disagree in
details with regard to the
transformation of the impure
matter to pure matter and
availability of an item.
While a significant number
of the jurisprudents stated
that all the impure matters
have been gone under
trans-formation would be
pure and the other part of
them stated that an item that
structure is impure will not
be pure in any way. Thus dif- ferent re-sults have emerged
on issues related to details.
Some samples of transfor- mation in the texts of Islamic
jurisprudence are stated to
be incompatible with the
technological laboratory
data because they have been
formed according to the
conditions and approaches
of the period of time they
were written. Therefore,
reevaluating the examples
and presenting the results to
those concerned is thought
to be beneficial.
This article came to the
conclusion that a common
platform consisting of the
experts on chemistry, med- icine, physics, engineering
and fiqh can be established
in current
conditions. By this way,
common results are thought
to be obtained by taking the
advantage of the advanced
laboratory facilities.

Abstract
Necis/haram maddelerin tabiî ortamlarında veya müdahale
ile farklılaş(tırıl)arak farklı bir maddeye dönüş(türül)mesine
genellikle istihâle denilmektedir. Genel bilgi vermesi için
fıkıh ekollerinin esas aldıkları bazı ortak örnekler ve değerlendirme
yöntemleri ortaya konulmaya çalışılmıştır.
İstihâle terimi için ortaya konulan tanımlar birbirine yakın
olmakla birlikte necis bir maddenin tâhire dönüşmesi ve
kullanılabilirliği ile ilgili detaylarda ihtilâfa düşülmüştür.
Fakihlerin önemli bir kısmı istihâle geçiren bütün necis
maddelerin tâhir olacağını belirtirken diğer bir kısmı, yapısı
necis olan bir maddenin hiçbir şekilde tâhir olamayacağını
belirtmişlerdir. Neticede fürûa taalluk eden konularda farklı
sonuçlar ortaya çıkmıştır.
Fıkıh metinlerinde yer alan bazı istihâle örnekleri, dönemin
imkânları ve yaklaşımlarına bağlı olarak verildiği için zaman
zaman gelişmiş laboratuvar verileri ile uyuşmadığı dile getirilmektedir.
Bundan dolayı konuyla ilgili örneklerin yeniden
değerlendirilerek ilgililere sunulmasının faydalı olacağı
düşüncesi hâsıl olmaktadır.
İstihâle daha çok gıda, sağlık ve hijyen gibi konularla ilgili
olduğu için günümüz şartlarında kimya, tıp, fizik, gıda
mühendisliği ve fıkıh bilim dallarından uzman kişilerin
oluşturacakları ortak platformlarda, gelişmiş laboratuvar
imkânlarından yararlanılarak ortak sonuçların elde edilmesi
gerektiği kanaatine ulaşılmıştır.
