THE WHITNESSING AS A FORMAL CONDITION OF MARRIAGE IN HANAFIS AND ITS EFFECTS ON CONSTRUCTION OF CONTRACT

Abstract

This article will examine witnessing in the marriage agreement and its effects on legal results. Hanafi law books of the Classical Age say if there aren’t witnesses in marriage, it will be invalid. Modern literature says that condition of validity depends on the presence of witnesses. The reason for this is that witnesses do not function as compulsory element for wedding. On this basis, whether marriages without witnesses are valid or invalid is discussed. Additionally, marriage is similar to commercial law. Considering this, it is understood that there is distinction between fasid and batil marriage. We know with certainty that marriage is more favourable than supererogatory worship. It is understood that marriage is similar to worships. Therefore, there isn’t any distinction between fasid and batil marriage. Besides, witnesses function as formal condition for marriage. Considering this, if there aren’t witnesses and if marriage is invalid, it is understood that marriage is only a formal contract.
