The Change in Fatwa within The Context of Socoilogical
Effectivity of Fiqh
Abstract
A fatwa, which can be defined as an answer by a qualified faqih to a problem related to the daily life vis-a-vis its religious and legal aspect, has a dynamic characterBecause, apart from the rituals, the daily life, that is the daily interactions
of individuals and society, is active and open to change and
development.
The field of rituals, haram-halal and the legal quantitative provisions
in the sources (muqaddarat) is closed to change due to its religious
nature.
On the other hand, within the fiqh heritage there can be found decrees
with historical character as well as with universal nature. Thus,
the fatwas issued within the fields open to interpretation or about the decrees
that have historical nature are open to change upon some changeable
conditions, which are time, space, situation, tradition, knowledge,
need, political, economic and social conditions, the change in ability
and strength or depending on a general hardship. A counter attitude on
this issue means confining fiqh within the limitations of a historical
process that is bound with time, space, perception, tradition and need. It
is impossible to talk about the sociological effectivity of a legal system
that cannot address the perceptions and needs of the day.

Abstract
Yetkin bir fakihin, amelî hayata ilişkin bir meselenin dinî-hukukî hükmüne dair verdiği cevap olarak tanımlanabilecek olan fetva, dinamik bir karakter taşır. Çünkü ibadetler dışındaki amelî hayat yani birey veya toplumun günlük ilişkiler ağı canlı olup değişime ve gelişime açıktır. İbadet, haram-helal ve naslardaki sayısal şer’î hükümler (mukadderât) alanı ise dinî niteliği dolayısıyla değişime kapalıdır. Diğer taraftan fıkıh mirası içinde tarihsel karakterli hükümler bulunduğu gibi evrensel nitelikte olanlar da bulunur. İşte yoruma açık alanlarda veya tarihsel nitelik taşıyan hükümlerde olmak üzere daha önce verilen fetvalar; zamanın, mekânın, durumun, örfün, bilginin, ihtiyacın, siyasî, iktisadî ve sosyal şartların, imkân ve gücün değişimine veya umûmü’lbelvâya bağlı olarak değişebilecektir. Aksi tutum, fıkhın belli bir tarihsel zaman-mekân-algı-örf-ihtiyaç sarmalına hapsedilmesi anlamına gelecektir. Günün algı ve taleplerine hitap edemeyen bir hukuk sisteminin sosyolojik yürürlüğünden bahsetmek de mümkün değildir
