Uluslararası Örgütler Tarafından Yapılan Bireysel Temel Hak İhlalleri Durumunda Başvurulabilecek Hukuksal Önlemlere İlişkin Bir Değerlendirme

Abstract

Son yirmi yılda uluslararası toplumda meydana gelen değişikliklerden biri de uluslararası örgütlerin hem sayı hem de faaliyetlerindeki hızlı artıştır. Uluslararası örgütler devletler arasında kurumsallaşmış işbirliği için vazgeçilmez araçlardır. Devletlerin egemenliğine bağlı geleneksel faaliyetleri, giderek artan bir şekilde, uluslararası örgütler tarafından yerine getirilmektedir. Uluslararası örgütlerin giderek artan faaliyetleri, devletler arasında güçlü bir işbirliğine de neden olmaktadır. Diğer yandan, bu gelişme, baraberinde giderek artan riskleri de getirmektedir. Uluslararası örgütler faaliyetlerini büyük ölçüde ulusal sınırlar içinde yürütmelerinden dolayı, doğal olarak bireylerin haklarına zarar vermeleri olasıdır. Bu nedenle, uluslararası örgütlerce ihlal edilen bazı insan hakları ve bu ihlallerin nedenleri konusunda, uluslararası toplumda farklı arayışlar mevcuttur. Uluslararası toplumdaki bu arayışların temel konusu uluslararası örgütlerin hukuki sorumluluklarının nasıl sağlanabileceğine ilişkindir. Makalemiz, devletlerin yürüttükleri bazı faaliyetlerin uluslararası örgütler tarafından yerine getirilmeye başlanmasıyla birlikte ne gibi hukuki güvencelerin sağlaması gerektiği ve icra edilen faaliyetler için ne gibi etkili sorumluluk mekanizmaları oluşturması gerektiğine ilişkindir.

AN EVALUATION RELATING TO LEGAL MEASURES THAT CAN BE APPLIED ON AN INDIVIDUAL BASIS RIGHTS VIOLATIONS BY INTERNATIONAL ORGANIZATIONS

Abstract

One of some changes which have taken place in the international community in the last twenty years is the rapid growth of international organization, both in number and in the scope of their operation. International organizations are indispensable instruments for institutionalized cooperation among states and There is a general trends to increase the transfer of power to them. Many of this powers were previously considered to be traditional powers of sovereign states. The increased activity of international organizations make strong intragation among states, however, it also generates growing risks to others. The numerous operations carried out by international organizations in the terirories of the vast majority of states may lead, naturally, to an infringements of the rights of individuals. Some of the potential individual human rights abuses by international organizations and reasons why the legal responsibility of international organizations should be emphasized in the international community are discussed. What is necessary are legal safeguards ensuring that whenever state tasks are transferred to nonstate actors, the power to exercise governance activities is made conditional on the existence of an effective mechanism of responsibility.
