Official ideology and judicial activism
Abstract
In this article,
constitutional review and its legitimacy emerged as the result of awareness of
fundamental rights and freedoms after World War II is studied beginning with
constitution movements which are based on natural law and aim to delimitate the
state. On the other hand, the issue of that constitutional court judge should contribute
to development of rule of law and democracy via making constitutional norm’s
interpretations based on human rights as official ideology is examined.
Furthermore, that any other interpretations of judge except those are based on
rights will cause discussions of judicial activism is explained through the
