A Perspective to Compulsory Hospitalization and Treatment of Psychiatric Patients

Abstract

Compulsory hospitalization means hospitalizing individuals and keeping them in the hospital without their will. Compulsory treatment is used when patients cannot give informed consent because they do not accept their illness and their need for treatment. Compulsory hospitalization and treatment are significant issues that lead to legal and ethical problems in Turkey and around the world. This situation is frequently encountered in patients with psychiatric disorders. This is because patients partially or completely lose their will in their behaviors and sometimes their opinions and feelings are abnormal due to the effect of their disease. Thus, compulsory hospitalization is a restrictive act without the consent of the patients, and it is open to exploitation when assessed broadly in terms of civil law and especially the law of persons, family law, and law of inheritance. Hospitalizing individuals without their consent is an act that restricts their freedom and violates their autonomy no matter what the reason is. A limited number of studies have been conducted on this subject in Turkey. In this review, developments about this issue from the past to the present have been evaluated, and an ethical perspective is tried to be created. The aim of this study is draw attention on a legal loophole in Turkey concerning compulsory hospitalization and treatment, and to point out ethical problems that nurses and physicians face as a part of their role of defending psychiatry patients having restricted rights and freedoms.
