THE PILOT JUDGMENT PROCEDURE IN THE CASE LAW OF THE EUROPEAN COURT OF HUMAN RIGHTS AND TURKISH CONSTITUTIONAL COURT

Abstract

This paper explores the comparison of the pilot judgment procedure to the individual and the collective judgment procedure at first. Then, the properties, functions, elements and the types of the pilot judgments have been discussed. In this context, the systemic problem and the role of the number of applications in the determination of the structural/systemic problem are also elaborated in the paper. We have demonstrated the picture of how the execution process of the pilot judgments developed, by giving examples from the Turkish Constitutional Court (TCC) and the European Court of Human Rights (ECtHR). The possible challenges in the execution of the pilot judgments were also examined. The solutions were sought through various possibilities on how to act if the violation arose from the legislation.

ANAYASA MAHKEMESİ VE AVRUPA İNSAN HAKLARI MAHKEMESİ KARARLARINDA PİLOT KARAR UYGULAMASI

Abstract

Bu makalede öncelikle pilot karar, çeşitli açılardan bireysel karar ve toplu karar yöntemiyle kıyaslanmıştır. Sonrasında pilot kararın işlevleri, nitelikleri, unsurları ve türlerinin ne olduğu ortaya konulmuştur. Bu kapsamda yapısal sorun ve bu sorunun tespitinde başvuru sayısının rolü de çalışmada detaylı bir şekilde işlenmiştir. Pilot karar ile ilgili Türkiye ve AİHM uygulamasından örnekler verilerek, kararın icrası sürecinin nasıl olduğu ortaya konulmuştur. Ayrıca, Türk Anayasa Mahkemesinin pilot kararının yerine getirilmesindeki muhtemel zorluklar incelemeye tabi tutulmuştur. İhlalin kanundan kaynaklanması halinde nasıl hareket edileceğine de çeşitli ihtimaller üzerinden cevap aranmıştır.
