MÜZAKERE (SÖYLEM) ETİĞİ, DEMOKRASİ VE MEŞRULUK

Abstract

Bu makale çalışmasında hukuk kavramına dönük sosyolojik meşruiyetin bir alt bölümünü oluşturduğunu düşündüğümüz demokratik meşruluk anlayışıyla ahlakî meşruluk arasındaki gerilime dikkat çekilerek sadece sosyolojik veya demokratik meşruiyetin yetersiz olduğu ve dolayısıyla doğal hukukun ahlakî meşruiyetinin demokratik meşruiyeti tamamlaması gerektiği düşüncesi temellendirilmeye çalışılacaktır. Özellikle, müzakereci/katılımcı demokrasi anlayışını amaçlayan müzakere/söylem (discourse) etiğinin meşruluk anlayışının klasik doğal hukuk anlayışı karşısındaki zayıflığı vurgulanacaktır
