DIGITALIZATION OF THE JUSTICE SYSTEM AND NEW COMMUNICATION TECHNOLOGIES: A REVIEW ON THE VISUAL INTERFACE OF THE NATIONAL JUDICIARY INFORMATICS SYSTEM (UYAP)

Abstract

With the digitalization of communication technologies, daily life has become much easier. In parallel with this digitalization, government institutions have also had to make some changes while conducting their business and transactions. The e-government system is at the forefront of these changes. The National Judiciary Informatics System (UYAP), which is the digitalized information system of the Ministry of Justice of the Republic of Turkey, has been integrated into this system. With the project, first of all, units such as courts and prisons affiliated to the Ministry of Justice and law enforcement units affiliated to the Ministry of Internal Affairs were included in the system. In this respect, significant progress has been made in preventing crime and crime by facilitating communication between affiliated units and reaching law enforcement units. Later, portals for various users such as lawyers and experts were added to the system, thus facilitating access to different courts, sending documents, or remote review. Finally, all citizens can access the system through the citizen portal. This has made it easier for citizens, who are the main element of the service, to access the justice system. By making it easier for different users to carry out their own transactions, UYAP also provides the opportunity for transactions to be carried out quickly. In addition, it is an important fact that it saves cost, time and effort. Thanks to UYAP portals, citizens can see all their judicial proceedings and history. In addition to the facilities it provides for those who provide judicial services such as lawyers, experts and mediators, UYAP also provides archive services. In this respect, users can view their completed transactions online through technologies such as the web, smartphone and tablet, regardless of time and place. They can produce documents under the same conditions and send these documents with e-signature or mobile signature. Receiving and sending information to citizens can also be done with the UYAP SMS system. All judicial notifications can be made to the registered e-mail addresses of official institutions. Since its establishment, UYAP has been increasing its functionality by bringing significant convenience to the Ministry of Justice personnel, other professional users and citizens. This study aims to reveal the convenience and impact that the UYAP system brings to users, which allows quick and easy access to the information recorded with the database system. Content analysis of the qualitative method was applied in the study examining UYAP, which provides easy, fast and safe delivery of services regardless of time and place through different portals. The study ultimately reveals that communication technologies bring great convenience to the justice system, reduce costs, and increase speed and transparency.

ADALET SİSTEMİNİN DİJİTALLEŞMESİ VE YENİ İLETİŞİM TEKNOLOJİLERİ: ULUSAL YARGI AĞI PROJESİ (UYAP)’NİN GÖRSEL ARAYÜZÜ ÜZERİNE BİR İNCELEME

Abstract

İletişim teknolojilerinin dijitalleşmesiyle birlikte gündelik hayat oldukça kolaylaşmıştır. Bu dijitalleşmeye paralel olarak devlet kurumları da iş ve işlemlerini yürütürken bazı değişimler yapmak zorunda kalmıştır. Bu değişimlerin başında e-devlet sistemi gelmektedir. Bu sisteme Türkiye Cumhuriyeti Adalet Bakanlığı’nın dijital ortama taşınmış bilgi sistemi olan Ulusal Yargı Ağı Projesi (UYAP) entegre edilmiştir. Proje ile öncelikle Adalet Bakanlığı’na bağlı mahkeme, cezaevi gibi birimler ile İçişleri Bakanlığı’na bağlı kolluk birimleri sisteme dahil edilmiştir. UYAP kurulduğu günden itibaren başta Adalet Bakanlığı personeli olmak üzere diğer meslek kullanıcıları ve vatandaşlara önemli kolaylıklar getirerek işlevselliğini artırmaktadır. Bu çalışma veri tabanı sistemi ile kaydedilen bilgilere, hızlı ve kolayca ulaşılabilmesini sağlayan UYAP sistemin kullanıcılara getirdiği kolaylık ve etkiyi ortaya koymayı amaçlamaktadır. Farklı portallar aracılığıyla hizmetlerin zaman ve mekân ayrımı olmaksızın kolay, hızlı ve güvenli bir şekilde ulaştırılmasını sağlayan UYAP’ı inceleyen nitel yöntemin benimsendiği bu çalışma derleme bir çalışma niteliği taşımaktadır. Çalışma sonuçta iletişim teknolojilerinin adalet sistemine büyük kolaylıklar getirdiğini, maliyeti azalttığını, hızı ve şeffaflığı artırdığını ortaya koymaktadır.
