Public Policy Analysis for Children Dragged into the Crime in Turkiye

Abstract

Birleşmiş Milletler Genel Kurulu tarafından 20 Kasım 1989 tarihinde benimsenen Çocuk Hakları Sözleşmesi 2 Eylül 1990 tarihinde kabul edilerek yürürlüğe girmiştir. Türkiye; mezkûr sözleşmeyi 14 Ekim 1990 tarihinde imzalamış ve 27 Ocak 1995 tarihinde ResmîGazete’de yayımlanarak yürürlüğe girmiştir. Sözleşme’nin özellikle 37 ve 40. Maddeleri suça sürüklenen çocukların korunmasına yöneliktir. Hem imza attığı bu Sözleşme’nin gereği hem de Avrupa Birliği (AB)’ne uyum sürecinin gereği olarak Türkiye suça sürüklenen çocuklara yönelik uygulamalarını ve mevzuatını değiştirmek durumunda kalmıştır. Adalet sistemindeki suça sürüklenen çocuk sayısında var olan hızla artış bu değişimin mümkün olduğunca hızlı olmasını gerektirmektedir. Bu ise kararlı bir kamu politikasının varlığı ile gerçekleşebilir. Bu çalışma, için soruna yönelik geliştirilen kamu politikalarının analiz edilmesini, böylelikle politikanın anlaşılmasını amaçlamaktadır. Analizde Sabatier’in süreç modeli esas alınmıştır.

Public Policy Analysis for Children Dragged into the Crime in Turkiye

Abstract

The Convention on the Rights of the Child, adopted by the United Nations General Assembly on 20 November 1989, was adopted on 2 September 1990 and entered into force. Turkey: The aforementioned signed the contract on 14 October 1990 and entered into force by being published in the Official Gazette on 27 January 1995. Articles 37 and 40 of the Convention are specifically for the protection of children who are dragged into crime. Both parties were in need to sign this convention because both Turkey’s implementations regarding the children dragged into the crime and its process of adaptation to EU legislation had to change as required by the contract. The rapid increase in the number of children dragged into the crime in the Justice System requires this change to be as fast as possible. This can be achieved by the existence of a determined public policy. This study aims to analyze the public policies developed for the problem in order to evaluate the policies followed.
