Regulatory Approaches for the Protection of Personal Data of Unborn Children and Deceased Persons

Abstract
The fact that the concept of protection of data belonging to individuals, which came to the agenda in order to expand the fundamental rights and freedoms of individuals, is restricted to “living individuals” has led to some uncertainties and debates, especially in research and practice related to health. At the center of the discussions is the definition of “natural person” in both Turkish and European legislation. Although not directly within the scope of this definition, there are two basic situations that intersect and overlap with this definition for various reasons. One of them is the issue of protection of personal data related to unborn babies, and the other is the issue of protecting data of deceased persons.
In this study, regulatory approaches and functioning of personal data regarding unborn children and deceased persons in Turkey and Europe were examined. The various problems due to these facts have been evaluated and analytical regulatory approaches have been recommended.

Doğmamış Bebeklerin ve Ölmüş Kişilerin Kişisel Verilerinin Korunmasında Düzenleyici Yaklaşımlar

Abstract
Bireylerin temel hak ve özgürlüklerini genişletmek amacıyla gündeme gelen bireylere ait verilerin korunması kavramı “canlı bireyler” ile kısıtlanmış olması özellikle sağlık ile ilgili araştırma ve uygulama konularında bir takım belirsizliklere ve tartışmalara yol açmıştır. Tartışmaların odağında ise hem Türkiye mevzuatında hem de Avrupa mevzuatında “gerçek kişi” tanımı yer almaktadır. Bu tanımın doğrudan kapsamı içinde yer almamakla beraber, bu tanımla çeşitli nedenler ile kesişen ve örtüşen iki temel durum söz konusudur. Bunlardan birisi doğmamış bebekler ile ilgili kişisel verilerin korunması konusu, bir diğeri ise ölmüş kişilere ait verilerin korunması konusudur.
Bu çalışmada, doğmamış bebekler ve ölmüş kişilere yönelik kişisel verilerin Türkiye ve Avrupa’da ele alınış ve işleyiş biçimleri irdelenmiştir. Bunların yol açtığı sorunlar değerlendirilmiş ve çözümsel düzenleyici yaklaşımlar ortaya konmuştur.
