Abstract
According to the most reliable point of view in the Islamic Fiqh, the state is not allowed to deal with public property except for supervising the utilization of it and preventing conflicts among people for investing it. Therefore, all things that have no human interfere and are necessary for the general public should not be available for total private individual property or group property. The ruler may give some people part of this public property just to use it, but not to own it, according to the public interest. As an application of that; it is not allowed to nationalize in the system adapted by some Arab governments last century, rather if the ruler sees some interest in taking some of the property with fair compensation or even with no compensation just in case of necessity , he may do it. Generally speaking, the ruler behavior with public property and the state property is connected with the public interest. God knows.
Abstract
وفقاً للاتجاه الأقوى في الفقه الإسلامي فإنَّه ليس للدولة أن تتصرَّف في الأملاك العامة إلا بالإشراف على الاستفادة منها ، ومنع النزاع بين الناس في استثمارها . و بناءً على ذلك فإنَّ كلَّ ما لم تتدخَّل فيه الصنعة البشرية وكان ضرورياً لعامة الناس وجب منْعُ الأفراد والجماعات من تملُّكِهِ تَمَلُّكاً تاماً، ويجوز للحاكم أن يُقْطِعَ ( يمنحَ ) بعضَ الناس شيئاً من هذه الأموال العامة إقطاعَ انتفاعٍ ( لا تملُّك ) للمصلحة . و من تطبيقات ذلك أنَّهُ : لا يجوز التأميم وفق الأنظمة التي تبنَّتها حكوماتٌ عربيَّةٌ في القرن الماضي ، لكن إن رأى الحاكم مصلحةً في نزع بعض الملكيات مع التعويض العادل عنها أو دونه في حال الاضطرار فيجوز له ذلك . و على العموم فإنَّ تصَرُّفَ الحاكِمِ في الأموال العامة وأملاك الدولة منوط بالمصلحة ، والله أعلم.
