Abstract

Değişim kaçınılmaz bir olgudur. Tarih boyunca değişmeyen neredeyse hiçbir şey yoktur. İslâm, fert ve toplum hayatına yön vermek, insanları doğru yola iletmek ve getirdiği ilkeler doğrultusunda yaşamalarını temin etmek için gelmiştir. İslâm hukuku, gerek Kur’an ve sünnetin genel karakteri gerekse koyduğu prensipler ve ilkelerle sosyal değişime bağlı olarak her coğrafyada insanların ihtiyaçlarını karşılayabilecek özgün bir hukuk sistemidir. Önemli olan başta ictihad müessesesi olmak üzere İslâm hukukuna bu dinamizmi veren vasıtaları işletebilmektir.

Islamic Law In The Axis of Social Change

Abstract

Change is an inevitable phenomenon. ThroChange, social change, ijtihad, flexibility in verdicts, universality in Islamic law, change of verdictsughout history, there is almost nothing that has remained unchanged. Islam has come to direct the individual and social lives, to lead people to the true path, and to ensure that they live in accordance with the principles it brought. Islamic law is a unique judicial system that can meet the requirements of people from all geographies based on social change with both the general character of the Qur’an and the Sunnah, and the principles and precepts it set up. The important issue is to run the mechanisms that provide this dynamism to Islamic law, particularly the establishment of ijtihad (deducing judgement).
