Abstract

Medâlim (Atrocities Court) in Islamic law is an authorized court Court which the normal courts could not take handle of troubled the cases of peoples, bandits, and terrorists because of fear and Cover of fear. This court was established with great authorities for liste ning to people’s complaints and preventing unjustices. Atrocities must represent the highest authority for this reason. Its first and real owner is head of state.

İslam Hukukunda Olağanüstü Yetkili Bir Mahkeme Olarak Velâyetü’l-Mezâlim (Mezâlim Mahkemeleri)

Abstract

İslam Hukukunda Mezâlim Mahkemeleri, normal yargı organlarının, korkma ürk me sebebiyle bakamayacağı, belalı insanların, şehir ve dağ eşkiyalarının ve teröristlerin davalarına bakan yetkili bir mahkemedir. Bu, halkın şikâyetlerini dinlemek, haksızlıkları önlemek maksadıyla kurulmuş geniş yetkili bir mahkemedir. Mezâlim, yüksek gücü tem sil etmesi zorunludur. Bu nedenle onun ilk ve hakiki sahibi devlet başkanıdır.
