Abstract
من المعلوم بالضرورة عند أهل العلم أن الشريعة الإسلامية خالدة، لأنها رسالة خاتم النبيين صلى الله عليه وسلم، وخلود الشريعة يعني صلاحية رسالة النبي صلى الله عليه وسلم لكل زمان ومكان، وما أن كثُرَ في عصرنا هذا المطالبة بتجديد الدين أو الخطاب الديني، إلا أن البعض أغرب وحاول جاهداً تمييع ثوابت الدين والطعن في مصادر التشريع والسنة النبوية بحجة تجديد الخطاب الديني، لذلك حرصت على إبراز حقيقة الشريعة الإسلامية وأنها صالحة للاستجابة لتغيرات الواقع، وبإمكانها استيعاب المستجدات، وبينت نوعي الأحكام الشرعية من حيث الثبات والتغير، كما قمت بعرض بعض مظاهر استجابة الشريعة لتغيرات الواقع، فالشريعة الإسلامية ثابتة مستمرة خالدة تستجيب للمتغيرات ولا تتغير، وتتجاوب مع المستجدات ولا تتجدد لأنها رسالة كاملة خالدة.
The Validity of Islamic Alshryet to Respond to Reality Changes Fatwa Changes with Changing Reality a Model
Abstract
It is well known to the scholars that the Islamic law is immortal, because it is the message of the Seal of the Prophets, and the immortality of the law means its validity for every time and place in which the message of the Prophet is valid. Legislation and the Sunnah of the Prophet under the pretext of renewing religious discourse, it was necessary for us to be careful to show the validity of the Islamic law to respond to changes in reality and their response to developments, and to clarify the two types of legal provisions between persistence and change, and I also presented some aspects of the Sharia’s response to changes in reality. Constant immortal, continuous lamma that responds to changes and does not change, and responds to developments and is not renewed because it is a complete and immortal message.
