The Reasons for Abu Ja‘far At-Tahâwî To Leave Shafiî Sect and His Reasons for Opposition To The Hanefi Imams

Abstract

Abu Ja‘far at-Tahâwî (d. 321/933) is one of the early jurists of the early Hanafi sect. Born and raised in Egypt and made important contributions to the development of Hanefi sect in Egypt. In his days he was accepted as the representative of Hanefi sect in Egypt. Tahâwî lived in a period when the spirit of sectarian and imitation of imams did not yet exist. While he was a member of Shafii sect till twenty years old, he was transferred to Hanafi school by the effect of Hanefî judges assigned to Egypt. Despite the fact that he act according to the methodology of the Hanafi imams, In many fiqh issues, he opposed the Hanafi imams and revealed his own views. Therefore the subject of our study is to identify the reasons for leaving the sect of Shafiî and the reasons of opposition to Abû Hanifa (d. 150/767) who was the founder and leader of the Hanafi sect and Imam Abû Yusuf (d. 182/798) and Imam Mohammad (d. 189/805) who were the students of Imam Abû Hanifa and the first conveyers of the sect of Hanafi.

Ebû Ca‘fer et-Tahâvî’nin Şafiî Mezhebinden Ayrılma ve Hanefi İmamlarına Muhalefet Nedenleri

Abstract

Ebû Ca‘fer et-Tahâvî (v. 321/933) Hanefi mezhebinin erken dönem fakîhlerindendir. Mısır’da doğup yetişmiş, Hanefi mezhebinin Mısır’da gelişmesine önemli katkıları olmuş bir fakîhtir. Yaşadığı dönemde Hanefi mezhebinin Mısır’daki temsilcisi kabul edilmiştir. Tahâvî, mezhep taassubu ve taklit ruhunun henüz oluşmadığı bir dönemde yaşamıştır. Yirmi’li yaşlara kadar Şafiî mezhebine mensup iken Mısır’a atanan Hanefî kâdıların da etkisi ile Hanefî mezhebine intikal etmiştir. Genel anlamda Ebû Hanife ve İmameyn’in tesis ettiği usûl kaideleri çerçevesinde içtihat etmekle birlikte birçok fıkhî meselede Hanefî imamlarına muhalefet ederek kendi görüşlerini ortaya koymuştur. Çalışmamızın konusu, İmam Tahâvî’nin Şafiî mezhebinden ayrılma, Hanefî mezhebinin kurucu imamı Ebû Hanife (v. 150/767) ile öğrencileri İmam Ebû Yusuf (v. 182/798) ve İmam Muhammed’e (v. 189/804) muhalefet nedenlerini tespit etmektir.
