Abstract

İslam insan hakları düzenlemeleri ile Batılı insan hakları düzenlemeleri kıyaslandığında, İslam’ın belirlediği hak ve hürriyet alanlarının daha geniş olduğu görülmektedir. İslam hukukunda şimdiye kadar başka hiçbir hukuk sisteminde düzenlenmemiş hak kategorileri ve hürriyet alanlarının belirlendiğine şahit olunmaktadır. Bununla birlikte günümüzde Müslümanların insan haklarını geliştirmek ya da ona yeni şeyler eklemekten ziyade onun tüketicisi konumunda bulunduğu gözlenmektedir. Çalışmada, İnsan Hakları Evrensel Beyannamesi ile kıyaslandığında Müslüman toplumların İslam’ın insan hakları görüşüne çok da destek vermediği ve onun pratik hayata ve mevcut insan hakları düzen lemelerine eklemlenmesi için gereken çabaları sarf etmediği görülmektedir. Çalışmada vurgulanan husus, İslam insan düşüncesinin, insanın haklara ve hürriyetlere sahip sosyal bir varlık olduğunu, hem kendisine hem de içinde yaşadığı topluma karşı görev ve sorumluluklarının bulunduğunu da kabul ve beyan etmesidir.

Universal Declaration of Human Rights and Islam

Abstract

When the regulations on the Islamic human rights and the present human rights regulations are compared, it seems the fields of right and freedom which are de termined by Islam for human are wider than the regulations on human rights which are based on the westerner norms. It is witnessed to be determined some categories of rights and fields of freedom in the Islamic Law which have not ever held in any legal system. However, it is observed that the Muslim community has a position of consuming human rights rather than developing or adding new things. Under the study, it is seen that the Muslim communities do not support the human rights view of the Islamic Law more and exert necessary efforts to articulate it into the life and the present regula tions on human rights when compared with Universal Declaration of Human Rights. This study emphasizes that the human rights view of Islam accepts and declares that human is a social being who has rights and freedoms and he has duties and responsibilities against his community in which he lives and other people as is for himself.
