The Role of Pre-Islamic Arab Tradition in Islamic Inheritance Law

Abstract

The source of Islamic inheritance law is the Qur'an. However, the rulings in the Qur’an are not highly detailed when it comes to specific aspects of inheritance. There are certain gaps that allow for various interpretations of the prescribed shares. While the foundations of Islamic inheritance law are found in the Qur’an, in practice, the shares established in the Qur’an can be seen as a guide for resolving inheritance issues within the Muslim family. Nevertheless, despite being a concrete manifestation of divine revelation, the Qur’an did not introduce an entirely new system of inheritance law. This study examines the direct or indirect influence of pre-Islamic Arab tradition on the inheritance practices of Muslim families. The aim of this study is to analyze the continuities and effects of pre-Islamic tradition in Islamic inheritance law.

İslam Öncesi Arap Geleneğinin İslam Miras Hukuku’ndaki Rolü

Abstract

İslâm miras hukukunun kaynağı Kur’an’dır. Kur’ân’ın hükümleri, mirasla ilgili özel hususlara temas edecek şekilde detaylı değildir. Hisselerin farklı açılardan yorumlanabileceği bazı boşluklar mevcuttur. İslam miras hukukunun temelleri Kur’an’da yer almaktadır. Uygulamada Kur’ân’da belirlenmiş hisselerin Müslüman ailenin miras meselelerini çözmede bir rehber olduğu düşünülebilir. Bununla birlikte Kur’ân’ın, ilahî vahyin somut hali olmasına rağmen, miras hukukunda tama men yepyeni bir sistem getirdiği söylenemez. Bu çalışmada İslâm öncesi Arap geleneğinin doğrudan veya dolaylı olarak Müslüman ailenin mirasçılığına etkisi ele alınacaktır. Bu çalışmanın amacı İslam öncesi geleneğin İslam miras hukukunda mevcut uzantı ve etkilerini analiz etmektir.
