Abstract
In this study, lexical and term definitions of the notions of social fact, fatwa and nevāzil have been introduced in an effort to present the relationship between these con cepts. The notion of social fact, which is widely employed today in the field of law and is one of the fundamental notions of the sociology of law, has been tried to establish as to in which kind of books it plays a part and how in the literature of Islamic law. This establishment is conducted via the written work of Ebu’l-Leys Semerkandi, “The Book of Newāzil”, which is the first example of nevāzil class of works in the sect of Hanefi. In The Book of Newāzil, template expressions, notions and subjects, in which the emphasis of social fact is explicit, was exami ned in particular. The examples of fatwa and the template expressions, which is widely used by the Author, have been translated and attempted to interpret in this study

Abstract
Bu çalışmada, sosyal olgu, fetvâ ve nevâzil kavramlarının sözlük ve terim anlamları verilerek kavramlar arası ilişkiler ortaya konmaya çalışılmıştır. Bugün, hukuk sahasında çokça kullanılan ve hukuk sosyolojisinin temel kavramları arasında yer alan sosyal olgu kavramının İslam hukuk literatüründe, hangi tür kitaplar içerisinde ne şekilde yer aldığı tespit edilmeye çalışılmıştır. Bu tespit, Hanefi mezhebinde nevazil türü eserlerin ilk örneği olan Mâverâünnehr ulemasından Ebu’l-Leys es-Semerkandî’nin (ö.373/983) “Kitabu’n-Nevâzil” isimli yazma eseri üzerinden yapılmıştır. Kitabu’n-Nevâzil’de, özellikle sosyal olgu vurgusunun açıkça görüldüğü kalıp ifadeler, kavramlar ve konular incelenmiştir. Müellifin sıkça kullandığı ifade kalıpları ve verdiği örnek fetvalar, tespit edilerek yorumlanmaya çalışılmıştır.
