An Analysis of the Sources of the Afghanistan Civil Code
Abstract
Ensuring justice in society and preserving social order are among the important duties of individuals and communities. In order to fulfill this duty firmly, laws must be established. Laws are prepared according to the religious, historical, economic, and cultural values dominant among people in every society. Since the people of Afghanistan are Muslim and Islam generally shapes social life, Islamic law forms the basis of the sources of the Civil Code of Afghanistan, as well as other laws. This situation started with the advent of Islam in Afghanistan and has continued until today, even though it has undergone some changes. For this reason, the articles related to Islamic law have remained constant in all constitutions implemented in Afghanistan. In other words, the superiority of Islamic law in the legal system of the country is mentioned at the beginning of all the constitutions. It is possible to divide the sources of the Civil Code of Afghanistan into two: general sources and special sources. Islamic Law, Afghan Constitutions, customs, and doctrinal views constitute the infrastructure of the Afghan legal system and are among the general sources of this law. In addition, the lawyers who prepared this law benefited from a number of laws and books such as Majallah al-Ahkam al-Adliyyah, the New Egyptian Civil Code, the Iraqi Civil Code, and Murshid al-Hayran, which are considered special sources of this law. The Afghanistan Civil Code took a long period of time to prepare and subsequently became a comprehensive civil code. Before the preparation of this law, various issues related to civil law, such as marriage, had been addressed separately, and each of them had gained official status through legal regulations. In this study, an attempt is made to determine by whom the Civil Code of Afghanistan was prepared, what its content consists of, which sources were used, and the influence rates of these sources. In addition, the level of influence of Majallah al-Ahkam al-Adliyyah on the formation of the Afghanistan Civil Code and the method of citation followed in this process will be discussed.
