The Main Issue in the Aegean Sea: (Un)Forgotten Turkish Islands

Abstract

The main purpose of this paper is to examine the Turkish Aegean Islands, whose sovereignities had not been ceded to Greece via international treaties. In this frame, firstly as a new notion “Blue Country” idea will be defined in general, then the significance of the Aegean Sea and its importance in usage for Turkey as well as other regional states will be outlined. Later on, the notion of “Lausanne Balance” will be examined, and then the judiciary basis of the “Gray Zones” conflict which had developed out of of Kardak Rocks crisis will be reviewed. At last, a final evaluation regarding the main issue will try to put an end at the paper. This research intends to explore why the issue of islands whose sovereignities are unidentified is the main core of the Aegean conflicts; what the Lausanne Balance in the Aegean means as well as why the Aegean Sea and its usage is important for turkey and other riparian states rather than investigating juridical dimension of the issue in-depth and far from comparative analysis with comparable examples in the world. Therefore, this study wishes to invite readers to participate in the survey with unanswered legal questions that need further investigation. The legal dimension of the problem related to the argument of the parties need to work together to offer the opinion of place, both because of lack of work would exceed the target of the legal dimension of the subject, because the international marine legal experts by until today and is thought to be the subject of other studies in the future.

EGE’DE TEMEL SORUN: UNUTUL[MAY]AN TÜRK ADALARI

Öz

Bu çalışmanın ana amacı, Türkiye’nin uluslararası antlaşmalarla egemenliklerini Yunanistan’a devretmediği Ege’deki Türk Adaları’nı araştırmaktır. Bu amaca varmak için, ilk önce “Mavi Vatan” kavramı irdelenecek, daha sonra Ege Denizi’nin ve kullanımının Türkiye ve çevre ülkeler için önemi ortaya konulacak; müteakiben Lozan Dengesi irdelenerek, Kardak Krizi ile çıkan “Gri Bölgeler”in hukuki veçhesi özetle incelenecek, müteakiben nihai bir değerlendirmede bulunulacaktır. Bu çalışma, meselenin hukuksal boyutunu derinlemesine ve dünyadan benzer örneklerle karşılaştırmalı analizden ziyade, Ege’nin ve bu denizin kullanımının Türkiye ve bölge ülkeleri için önemini, Ege’de Lozan dengesinin ne anlama geldiğini ve egemenliği tartışmalı adaların neden Ege sorunlarının temelini teşkil ettiğini ortaya koymak niyetindedir. Dolayısıyla bu çalışma, üzerinde daha fazla sorgulamayı gerektiren yanıtlanmamış hukuki sorularla, okuyucuyu da araştırmaya katılmaya çağırmak arzusundadır. Sorunun hukuki boyutuyla ilgili birçok argümanı tarafların görüşleriyle birlikte sunmaya çalışmak, gerek yer darlığı nedeniyle, gerekse çalışmanın hedefini aşacağından, konunun hukuksal boyutunun, uluslararası deniz hukuk uzmanları tarafından bugüne değin yapılmış ve gelecekte yapılacak başka çalışmaların konusu olduğu düşünülmektedir.
