THOUGHTS ON THE INTERSECTION OF TECHNOLOGY AND MARITAL PROPERTY LAW: THE POSSIBILITIES OF SMART CONTRACTS

Abstract

This study examines the intersection of technology and marital property law through the lens of smart contracts. It begins with a doctrinal overview, outlining the origins, conceptual definitions, and existing regulatory frameworks of smart contracts. Then, the analysis examines their practical applications across various legal fields, highlighting potential benefits, limitations, and risks. The study focuses specifically on matrimonial property relations, examining the characteristics of matrimonial property regimes and evaluating the potential of smart contracts to automate certain processes within this domain. The work goes on to consider in particular the challenges and constraints that hinder seamless integration of smart contracts into family property law. The study concludes that, while not impossible, the adoption of smart contracts in this area requires careful consideration and is most viable as a supplementary tool for specific transactions.
