Avrupa İnsan Hakları Mahkemesi Kararlarında Umut Hakkı Bağlamında Suçluların İadesi

Abstract

Avrupa İnsan Hakları Mahkemesi, koşullu salıverilme imkanı bulunmayan müebbet hapis cezalarının Avrupa İnsan Hakları Sözleşmesi’nin üçüncü maddesine aykırılık taşıdığını, bu cezaların infazı hususunda çeşitli gereklilikler belirleyerek ortaya koymuştur. Bu husus gerek AİHM’nin kararlarında gerekse de öğretide müebbet hapis cezalarının bir umut barındırması gerektiği şeklinde ifade edilmiştir. Böylece umut hakkı AİHS’nin üçüncü maddesinin koruduğu bir hak olarak ortaya çıkmıştır. Ancak AİHS’ye taraf devletlerin, Sözleşme’nin üçüncü maddesine uygun şekilde müebbet hapis cezasının infaz edilmesi ve mahkumlara öngörülebilir bir koşullu salıverilme imkanı tanınması yükümlülüğü başka bir sorunu daha gündeme getirmiştir. AİHS’ye taraf devletler, iade konusu suçun, iadeyi talep eden devlette AİHS üçüncü maddeye aykırı bir ceza gerektirmesi halinde bu iadeyi gerçekleştirmemekle sorumludur. Umut hakkı barındırmayan bir müebbet hapis cezası da AİHS üçüncü maddeye aykırıdır. İadeyi talep eden devletin müebbet hapis cezası infaz sisteminin AİHM standartlarına uygun bir koşullu salıverilme imkanı tanımaması ve iadeye konu suçun ilgili devlette böyle bir cezayı gerektirmesi durumunda talepte bulunulan devletin nasıl davranması gerekmektedir? AİHM’nin bu konudaki içtihatları, umut hakkına ilişkin içtihatlarından sonra gelişmiştir. Ancak AİHM’nin çeşitli gerekçelerle, umut hakkı bulunmayan devletlere iade meselesini değerlendirirken insan hakları bakımından dalgalı bir tutum izlediği görülmektedir. Bu çalışmamızda ilgili içtihatların gelişimini kronolojik olarak takip edecek ve AİHM’nin bu konudaki son içtihatlarında ortaya koyduğu ilkeleri ortaya koymaya gayret edeceğiz.

Extradition in the Case Law of the European Court of Human Rights in the Context of the Right to Hope

Abstract

The European Court of Human Rights (ECtHR) has held that life imprisonment without the possibility of conditional release is incompatible with Article 3 of the European Convention on Human Rights (ECHR), which prohibits inhuman and degrading treatment. This has led to the recognition of the “right to hope” as an essential element of human dignity, requiring that life sentences include a prospect of release and a chance for rehabilitation. States are thus obliged to ensure that such sentences allow for a meaningful review mechanism. This obligation has important implications for extradition proceedings. Where the offence underlying an extradition request may result in a life sentence that violates Article 3 -specifically, one lacking a real possibility of release - the requested state must refuse extradition to avoid facilitating a potential human rights violation. Accordingly, a life sentence without the right to hope may render extradition unlawful under the Convention. While the ECtHR has clarified this principle through landmark rulings such as Vinter and Others v. United Kingdom, its jurisprudence on extradition to states with incompatible penal systems has been less consistent. The Court’s approach has at times fluctuated, particularly regarding whether diplomatic assurances or general penal policies suffice to remedy potential violations. This study examines the evolution of the ECtHR’s case law on life imprisonment and extradition, focusing on the development and implications of the right to hope doctrine. By analyzing recent judgments, it aims to identify the core principles and assess the coherence of the Court’s current stance on this pressing legal issue.
