TÜRK HUKUKUNDA VERGİ GELİRLERİNİN AMACA TAHSİSİ SORUNU
Abstract
Devletlerin kamusal faaliyetlerini sürdürebilmeleri için başvurdukları en temel ve en geniş tabanlı finansman kaynağı vergilerdir. Vergi gelirlerinin hangi usul ve esaslar çerçevesinde kullanılacağı hususu ise kamu maliyesinin temel ilkeleri ile anayasal vergileme prensipleri doğrultusunda belirlenmektedir. Türk hukukunda vergi gelirlerinin kullanımına ilişkin temel yaklaşım, Anayasa’nın 73’üncü maddesiyle 5018 sayılı Kamu Malî Yönetimi ve Kontrol Kanunu hükümleri çerçevesinde şekillenmekte olup, vergi gelirlerinin genel bütçe içerisinde toplanmasını esas alan adem-i tahsis ilkesi benimsenmiştir. Anılan ilke uyarınca vergiler, kural olarak belirli bir kamu hizmetinin finansmanına özgülenememekte; bunun yerine tüm kamu giderlerinin ortak finansmanında kullanılmaktadır. Buna karşılık, uluslararası uygulamalarda tahsisli vergilerin özellikle çevre, sağlık ve sosyal güvenlik gibi alanlarda yaygın biçimde uygulandığı görülmektedir. Bu çerçevede çalışma, Türk hukukunda vergi gelirlerinin belirli kamu hizmetlerine doğrudan tahsis edilmesinin anayasal ve bütçesel nedenlerle genel olarak mümkün olup olmadığını incelemeyi amaçlamaktadır. Bu kapsamda, vergi gelirlerinin amaca tahsisi meselesi, ilgili anayasal ve mali ilkeler ışığında bütüncül bir yaklaşımla değerlendirilmekte; konu, mevcut hukuki çerçeve esas alınarak sistematik bir biçimde ele alınmaktadır.

THE PROBLEM OF EARMARKING TAX REVENUES FOR SPECIFIC PURPOSES IN TURKISH LAW
Abstract
Taxes constitute the principal and broad-based source of financing through which states perform public functions. The principles and procedures governing the use of tax revenues are determined within the framework of the fundamental principles of public finance and the constitutional principles of taxation. In Turkish law, the approach to the use of tax revenues is shaped by Article 73 of the Constitution and the Public Financial Management and Control Law No. 5018, which adopts the principle of non-earmarking by requiring tax revenues to be collected within the general budget. Pursuant to this principle, taxes may not, as a rule, be earmarked for the financing of a specific public service but are instead used to finance public expenditures as a whole. By contrast, international practice demonstrates that earmarked taxes are widely employed, particularly in the fields of environmental protection, healthcare, and social security. Against this background, this study aims to examine whether, under Turkish law, the direct earmarking of tax revenues for specific public services is generally permissible considering constitutional and budgetary considerations. Accordingly, the issue of earmarking tax revenues is evaluated through a holistic approach in light of the relevant constitutional and fiscal principles, and the subject is examined systematically on the basis of the existing legal framework.
