THE ELEMENT OF AUTHORITY IN THE OPERATION OR THE LEASING OF THE SCHOOL CANTEENS: WRONG APPLICATIONS IN TURKEY

Firstly, this paper will give information about the legislation about the use of canteens, buffets, cafeterias, dining halls, tea houses, gardens, parking areas, indoor halls for sports, conferences or any other purposes, and all the other free spaces,which are in the
ownership of the state treasury and assigned in behalf of the Ministry of National Education, in educational, social, cultural, sports, administrative, and commercial purposes. Afterwards, it will touch upon the illegitimate applications of the legislation about the operation or the leasing of these places by the Parent-Teacher Association. This paper aims to sort out the application that should be by presenting the provisions of the current legislation and the available applications. Due to the Organization of Ministry of
National Education in Turkey and the processes of leasing and the other dispositive transactions in these organizational units, the correction of the mistakes in the current application has a great imporrtance. This research will examine how these mistakes can be eliminated and the legal way of the application. Legislation Analysis Technique was used in this work. This research is the first and the only academic research on the related subject. Accordingly, it is predicted that it will make an important contribution both in the doctrine and in practice.

Bu çalışmada öncelikle Hazine mülkiyetinde olup; Milli Eğitim Bakanlığı (MEB) adına tahsis edilen okul, idari bina ve diğer eğitim alanlarında bulunan kantin, büfe, kafeterya, yemekhane, çay ocağı, bahçe, otopark ve boş alanlar ile spor, konferans ve çok amaçlı kapalı salonlarının eğitsel, sosyal, kültürel, sportif, yönetsel ve ticari amaçlarda kullanılması konusundaki mevzuat hakkında bilgi verilmektedir. Daha sonra bu alanların okul aile birliklerince işletilmesi ya da kiraya verilmesi konusundaki hukuka aykırı uygulamalara değinilmektedir. Yürürlükteki mevzuat hükümleri ile mevcut uygulamalar arasındaki farklılıklar ortaya konularak “olması gereken” uygulamaya ışık tutulması amaçlanmaktadır. Milli Eğitim Bakanlığı'nın tüm Türkiye'de teşkilatlanması ve bu teşkilat birimlerinde kiralama ve diğer tasarruf işlemlerinin yapılması nedeniyle, uygulamada mevcut olan hataların düzeltilmesi büyük bir öneme sahiptir. Mevcut çalışma bu hataların nasıl giderilebileceğini ve hukuki olarak olması gereken şeklini ortaya koymaktadır. Çalışmamızın gerçekleştirilmesinde mevzuat analizi tekniği kullanılmıştır. Makalemiz, ilgili konuda hazırlanmış ilk ve tek akademik çalışma olma özelliğini taşımaktadır. Bu nedenle, bu konuda gerek doktrinde ve gerekse de uygulamada önemli bir katkı sağlayacağı öngörülmektedir.
