Abstract

The casuistic provisions regarding compensation due to unlaw-ful criminal coercive measures such as arrest, search, detention etc. are considered in the Turkish criminal law. This study aims to ana-lyze the provision regulated in the acts number 466 and 5271.

Abstract

Haksız bir şekilde uygulana tutuklama, arama, yakalama gibi koruma tedbirleri nedeniyle tazminata hükmedilmesi Türk ceza hukukunda açık yasal düzenlemeler ile kabul edilmiştir. Bu çalışma ile 466 sayılı Kanun ile 5271 sayılı CMK’nın 141 ila 144. maddeleri ana hatlarıyla değerlendirilmesi amaçlanmıştır.
