Yargısal Akıl Yürütmenin İzinde: Kadın Cinayeti Davalarında Tasarlama ve Haksız Tahrik Ayrımına Dair Bir Yargıtay Analizi

Abstract

Bu çalışmanın amacı, Yargıtay Ceza Genel Kurulu’nun, kadın cinayeti konulu emsal kararlarında, kritik öneme sahip olan ‘kast’, ‘taksir’, ‘tasarlama’ ve ‘haksız tahrik’ gibi kavramları yorumlarken, failin suçun manevi unsuruna ilişkin zihin durumunu tespit etmek için başvurduğu davranışsal göstergeleri, kanıt değerlendirme pratiklerini ve örtük psikolojik varsayımları ortaya koymaktır. Çalışma, nitel araştırma desenlerinden çoklu vaka analizi yöntemiyle yürütülmüştür. Veri setini, amaçlı örneklemle seçilen 5 adet emsal niteliğindeki Yargıtay Ceza Genel Kurulu kararı oluşturmaktadır. Bu kararlar, içerik ve tematik analiz teknikleri kullanılarak incelenmiştir. Analiz, Yargıtay'ın failin zihin durumunu tespit ederken çok yönlü bir akıl yürütme pratiği sergilediğini göstermiştir: Kurul, bir yandan suç öncesi hazırlık gibi davranışsal göstergelerle ‘tasarlama’ kastını inşa ederken; diğer yandan maddi kanıtlarla çelişen ‘haksız tahrik’ iddialarını elemektedir. En önemlisi, Yüksek Mahkeme'nin, delillerle desteklenmeyen veya spekülatif kurgulara dayanan tasarlama mahkûmiyetlerini ‘şüpheden sanık yararlanır’ ilkesi gereği bozduğu tespit edilmiştir. Kararlarda ayrıca, maddi kanıtların sanık beyanı ve güvenilirliği düşük tanık ifadeleri gibi diğer delillere üstün tutulduğu hiyerarşik bir pratik saptanmıştır. Yargıtay'ın karar verme pratiği, rasyonel ve kanıta dayalı bir analiz çabası ile toplumsal cinsiyet rolleri ve onur kültürü gibi sosyo-kültürel kodların etkisi arasındaki gerilimi yansıtmaktadır. Bu durum, adli karar verme süreçlerinin arkasındaki karmaşık dinamikleri ve örtük varsayımları aydınlatmaktadır.

Tracing Judicial Reasoning: An Analysis of How the Court of Cassation Determines Mens Rea in Femicide Cases

Abstract

The aim of this study is to reveal the behavioral indicators, evidence evaluation practices, and implicit psychoB logical assumptions that the Court of Cassation's General Assembly for Criminal Matters employs to determine the perpetrator's state of mind regarding the mens rea when interpreting critical concepts such as 'intent' (kast), 'negligence' (taksir), 'premeditation' (tasarlama), and 'unjust provocation' (haksız tahrik) in precedent setting femicide cases. , The study was conducted using a qualitative multiple case study design. The data set consists of five precedent setting decisions from the Court of Cassation's General Assembly for Criminal Matters, selected through purposive sampling. These decisions were examined using content and thematic analysis techniques. The analysis revealed that the Court of Cassation employs a multifaceted reasoning practice to determine the perpetrator's state of mind. On one hand, the Assembly constructs the intent of 'premeditation' through behavioral indicators such as pre-crime preparation; on the other, it refutes claims of 'unjust provocation' that contradict material evidence. Most significantly, it was found that the High Court overturns 'premeditation' convictions that are unsupported by evidence or based on speculative narratives, applying the 'in dubio pro reo' principle. Furthermore, a hierarchical practice was identified that prioritizes material evidence over the defendant's testimony and unreliable witness statements. The Court of Cassation's decisionBmaking practice reflects a tension between the pursuit of a rational, evidenceB based analysis and the influence of socioBcultural codes, such as gender roles and honor culture. This illuminates the complex dynamics and implicit assumptions behind judicial decision-making processes.
