Arbitration in Concession Contracts
Abstract
Arbitrability of concession contracts, in our law, had not been possible for many years. However, in the 90s, in order to attract foreign investors for the construction of infrastructure facilities, arbitrability in these contracts was commenced to be contented. In parallel with these contentions, in 1999, necessary amendments were made in the Constitution which paved the way for the arbitrability of concession contracts. Whilst a number of studies have been conducted since then, applicable law and jurisdiction issues have not been sufficiently addressed. Therefore, this paper focuses on the issues of applicable law regarding administrative law - private law distinction and of jurisdiction regarding administrative courts - civil courts when an arbitral award issued at the end of such an arbitration procedure is challenged.
