Problems Arising in International Investment Law from the Characteristics of the European Union Law

Abstract

Bilateral investment treaties between European Union Members and Energy Charter Treaty where both the European Union and the European Members area party to become controversial due to the characteristics of the European Union Law after the Lisbon Treaty where direct investment became part of the exclusive competences of the European Union. Especially the relationship between the investment arbitration clauses in these treaties and the European Court of Justice needs to be elaborated. This paper aims to discuss these topics in light of the relevant arbitral awards and the decisions and opinions of the European Court of Justice.
