Problems Arising in International Investment Law from the Characteristics of the European Union Law

Öz

Bilateral investment treaties between European Union Members and Energy Charter Treaty where both the European Union and the European Members area party to become controversial due to the characteristics of the European Union Law after the Lisbon Treaty where direct investment became part of the exclusive competences of the European Union. Especially the relationship between the investment arbitration clauses in these treaties and the European Court of Justice needs to be elaborated. This paper aims to discuss these topics in light of the relevant arbitral awards and the decisions and opinions of the European Court of Justice.

Avrupa Birliği Hukukunun Yapısından Kaynaklanan Uluslararası Yatırım Hukukuna İlişkin Sorunlar

Öz

Lizbon Antlaşması’nın doğrudan yatırım konusunu devredilen münhasır yetkiler kapsamına almasıyla birlikte Avrupa Birliği Hukukunun yapısından kaynaklanan özelliklerden dolayı Avrupa Birliği üyelerinin mevcut iki taraflı yatırım antlaşmaları ve hem Avrupa Birliği’nin hem de Avrupa Birliği üyesi ülkelerin taraf olduğu Enerji Şartı Antlaşması’nın durumu tartışmalı hale gelmiştir. Özellikle bu antlaşmalarda yer alan tahkim düzenlemelerinin Avrupa Birliği Adalet Divanı ile ilişkisi incelenmesi gereken konulardan biri olmuştur.  Çalışma bu konulara ilişkin sorunları gerek hakem kararları gerekse Adalet Divanı’nın karar ve görüşleri ışığında tartışmayı amaçlamaktadır.
