The Legal Qualification of Recognition and Enforcement Decisions
Abstract
The court decisions made by the foreign state court shall be the effective in another country as final judgment and final evidence by means of being undergone a process of the recognition and enforcement decisions. However, it is important that the court decision taken in the foreign court should be described in the process of recognition and enforcement. Likewise, in the process of demand concerning the recognition and enforcement; The judging proceeding, whether demand is to be claimed as controversially, the participation of parties in the court, by whom the demand of recognition and enforcement will be requested, in what way the proof and evidences will be submitted in the court and finally, the evaluation of the court decision in terms of the legal remedy, are directly related to the qualification of recognition and enforcement demands. This study, fundamentally, was performed in order that the mentioned assessments can be carried out in terms of the recognition and enforcement demands.
